3. User Responsibilities
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- You are responsible for safeguarding your password and for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. Intellectual Property Rights
All content, designs, graphics, code, and other materials created by Divex remain our intellectual property unless explicitly stated otherwise in a separate agreement. You may not reproduce, distribute, or create derivative works without our prior written consent.
Any feedback, comments, or suggestions you may provide regarding our services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.
5. Payment Terms
Payment terms will be outlined in individual project agreements. Unless otherwise specified, invoices are due within 30 days of issuance. Late payments may incur additional fees.
For ongoing services, we may offer subscription-based billing. You agree to keep your billing information updated and to pay all charges incurred through your account at the rates in effect when the charges were incurred.
6. Limitation of Liability
Divex shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.
In no event will our total liability to you for all damages, losses, or causes of action exceed the amount you have paid to Divex in the last six (6) months, or €500, whichever is greater.
7. Termination
We reserve the right to terminate or suspend your access to our services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Upon termination, your right to use the services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Changes to Terms
We may modify these Terms at any time. Your continued use of our services following any changes constitutes your acceptance of the revised Terms. It is your responsibility to check our website periodically for changes to these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Romania.
